By accessing or using Survey Creators ("Service"), operated by Survey Creators ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our Service.

2. Description of Service

Survey Creators provides a cloud-based survey platform specializing in vendor assessment, employee surveys, and customer feedback solutions. Our Service includes survey creation tools, automated scoring capabilities, multi-workspace management, and analytics features.

3. Account Registration

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You must be at least 18 years old to use our Service

4. Subscription and Payment Terms

Free Account

We offer a free account. A valid credit card is not required to start your free account. You may choose to upgrade at any time.

Subscription Plans

• Starter Plan: $29.99 per month
• Professional Plan: $129.99 per month

Billing

• Subscriptions are billed monthly in advance
• All payments are processed through Stripe
• Prices are in US dollars and subject to change with 30 days notice
• You authorize us to charge your payment method on a recurring basis

Refund Policy

• Unused subscription time
• Partial month usage
• Changes in your business needs
• Dissatisfaction with the Service
• Account termination for Terms violation

You may cancel your subscription at any time to prevent future charges, but no refunds will be issued for the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Collect sensitive personal information without proper consent
• Send spam or unsolicited communications
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any illegal, harmful, or offensive purposes
• Resell or redistribute the Service without authorization

• The Service and its original content, features, and functionality are owned by Survey Creators
• You retain ownership of your survey content and data
• You grant us a license to host, store, and process your content to provide the Service
• Our templates and pre-written questions are licensed for your use within the Service

7. Data Processing and Privacy

Your use of our Service is also governed by our Privacy Policy. You acknowledge that:

• You are responsible for complying with privacy laws regarding your survey respondents
• We act as a data processor for survey response data
• You maintain ownership and control of your survey data
• You must obtain necessary consents from survey respondents

8. Service Availability and Support

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may perform scheduled maintenance with advance notice when possible
• Support is provided via email during business hours
• We reserve the right to modify or discontinue features with notice

9. Limitation of Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Survey Creators and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your survey content or data collection practices

12. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will cease immediately
• No refunds will be provided for any unused subscription time
• We may delete your data after 30 days unless legally required to retain it

13. Export Compliance

You may not use or export the Service in violation of U.S. export laws and regulations.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Tyler, Texas.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our Service at least 30 days before the changes take effect. Your continued use of the Service after the changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Survey Creators regarding the use of the Service and supersede all prior agreements and understandings.
